1. About these Terms

These Terms govern your use of Where Tourgo ("WTG," "we," "us" or "our") and its Costa Rica experience marketplace.

By creating an account, submitting a booking request, paying a reservation deposit or otherwise using WTG, you agree to these Terms and the policies incorporated by reference. You must be at least 18 years old and legally able to enter into contracts.

2. WTG's marketplace role

WTG provides a curated online marketplace where travelers can discover and reserve tours, activities and experiences supplied and performed by independent providers. Unless a listing expressly says otherwise, WTG does not own, operate or control an experience and is not the provider of transportation, guiding or activity services.

When a booking is confirmed, the service contract for the experience is between the traveler and the identified provider. WTG facilitates discovery, booking communications and collection of the displayed reservation deposit. Curation, identity checks or badges do not guarantee that an experience is risk-free or that every representation made by a provider is accurate.

3. Accounts and accurate information

  • Provide current, complete and truthful information.
  • Protect your sign-in credentials and promptly report suspected unauthorized access.
  • Do not impersonate another person, create deceptive accounts or use the platform for fraud, scraping or unlawful activity.
  • A person booking for others confirms they are authorized to provide their information and accept applicable terms on their behalf.

4. Listings, prices and booking

Each listing identifies the provider, important characteristics, full experience price, reservation deposit due to WTG, balance payable directly to the provider, currency, inclusions, restrictions and the applicable cancellation rule. Review all details before paying.

A payment may create a booking request rather than immediate confirmation. The reservation is confirmed only when WTG or the provider issues a confirmation. If the provider declines or cannot confirm availability, WTG will cancel the request and refund the deposit collected by WTG.

  • WTG charges only the reservation deposit displayed at checkout.
  • The traveler owes the displayed remaining balance directly to the provider under the confirmed payment terms.
  • WTG is not responsible for cash, card or other payments made directly to a provider, except where mandatory law says otherwise.
  • Exchange rates and bank or PayPal charges may affect the final amount charged by a payment provider.

5. Cancellations, changes and refunds

The Booking, Cancellation & Refund Policy and the policy displayed on the listing form part of these Terms. If they conflict, mandatory consumer law prevails, followed by the more specific written term shown to the traveler before payment.

6. Traveler responsibilities and safety

  • Read and comply with age, health, mobility, clothing, equipment and conduct requirements.
  • Disclose relevant accessibility needs directly and early enough for the provider to assess accommodations.
  • Follow lawful safety instructions and do not participate while impaired.
  • Maintain appropriate travel and medical insurance; adventure and outdoor activities can involve inherent risks.
  • Arrive at the confirmed meeting point and time with required identification or documents.

7. Provider responsibility

Providers are independently responsible for performing their experiences safely and professionally, maintaining legally required permits, insurance, trained personnel and equipment, and honoring the listing and confirmed reservation. Complaints about performance should be reported promptly to both the provider and WTG so they can be investigated.

8. Content, reviews and intellectual property

WTG and its licensors own the platform, brand and original content. You may use the platform only for personal travel planning or authorized provider operations. If you submit photos, reviews or other content, you retain ownership but grant WTG a worldwide, non-exclusive, royalty-free license to host, reproduce, adapt and display it for operating and promoting WTG. You confirm you have the rights needed to grant that license.

  • Reviews must reflect a genuine experience and may not be bought, coerced or manipulated.
  • Content may not be illegal, deceptive, discriminatory, threatening, invasive of privacy or infringing.
  • WTG may remove content or suspend accounts to protect travelers, providers, the platform or legal compliance.

9. Platform availability and liability

WTG works to keep the platform accurate and available, but features may change or experience interruptions. To the fullest extent permitted by law, WTG is not liable for indirect, incidental or consequential losses, or for a provider's independent acts or omissions. Nothing in these Terms excludes liability that cannot legally be excluded or limits mandatory consumer rights.

Where WTG is legally liable, its aggregate liability relating to one booking will not exceed the greater of the deposit paid to WTG for that booking or the minimum amount required by applicable law. This limitation does not apply to fraud, willful misconduct, gross negligence, personal injury caused by WTG where liability cannot be limited, or other non-excludable liability.

10. Suspension and termination

WTG may restrict or end access, remove a listing or cancel a booking when reasonably necessary for safety, fraud prevention, legal compliance, material breach or protection of users. Where practical and lawful, WTG will explain the reason and allow an opportunity to respond.

11. Governing law and disputes

These Terms are governed by the laws of Costa Rica. Before filing a claim, the parties should attempt in good faith to resolve it through WTG support for at least 30 days. Subject to mandatory consumer protections in your place of residence, disputes will be submitted to the competent courts of Costa Rica. Travelers retain any rights and forums that cannot be waived under applicable consumer law.

12. Changes and contact

WTG may update these Terms prospectively. Material changes will be communicated through the platform or account email before they take effect when required. The version accepted at booking remains available with the reservation record.
